Greg DeGulis to present at OSBA Environmental Law Seminar
The 34th Annual OSBA Environment, Energy and Resources Law Seminar, one of OSBA’s largest, packs a host of hot legal topics into two busy days of meetings on March 28 and 29, 2019. On Friday, March 29 at 1 pm, Greg DeGulis will be a part of the panel discussion Ohio Pipeline Litigation: Is the 6th Circuit the New ERAC? The panel includes Frank Merrill of Bricker & Eckler LLP as well as Lee Slone and Aaron Farmer of the Office of Ohio Attorney General Dave Yost.
Court Dismisses Pipeline Lawsuit
On March 12, 2019, Judge Kristin G. Farmer of the Stark County Court of Common Pleas granted the defense Motion to Dismiss in State of Ohio, ex. rel. v. Rover Pipelines, LLC, et al. (2017cv02216). The Court found that “the State of Ohio failed to act upon its rights specifically given to it pursuant to the Clean Water Act within the Act’s specified period of time.” As a result, Ohio EPA waived any right to oversight of the pipeline, which remains subject to FERC oversight. Water Infrastructure Improvement Act Opens New Paths to Affordable CWA Compliance for Local Governments
