White House Council on Environmental Quality Seeking Comments on NEPA
The Council on Environmental Quality (CEQ) is soliciting public comment through July 20 on its regulations implementing the National Environmental Policy Act (NEPA). NEPA requires federal agencies to assess the environmental effects of their proposed actions prior to making decisions. CEQ has published a list of twenty questions seeking feedback on specific points including the NEPA process and the scope of NEPA review. Greg DeGulis and Lauryn Kitchen published in ABA Committee Newsletter
Gregory DeGulis, Partner, and Lauryn Kitchen, Law Clerk, authored an article published in the June issue of the American Bar Association Section of Environment, Energy and Resources In-House Counsel Committee newsletter. Titled Gasoline, Diesel, and Oil: Recent Case Developments and the Avenues for Cleaning Up Sites Contaminated by Petroleum, the article reviews recent RCRA case law involving petroleum and also considers the use of Clean Water Act citizen suits to bolster the argument for cleanup.
