Local Government Practice
McMahon DeGulis serves governmental entities, including large cities, small towns, counties, municipalities, conservancy districts, waste management districts, water and sewer utilities and other regional authorities, such as port authorities. We are adept at providing advice as part of a broader team of professionals, which often includes in-house counsel, city and county attorneys, special outside bond and construction counsel and numerous environmental and engineering professionals.
Project highlights for our local government work include counseling a city regarding lakefront redevelopment plans and Great Lakes public trust issues; serving as trial counsel for a municipality in litigation stemming from the design and upgrade of a Water Pollution Control Plant; recovery of brownfield redevelopment costs for the benefit of multiple Ohio municipalities; counseling a port authority on complex issues of state and federal statutory and constitutional authority over submerged land leases in Lake Erie and in the implementation of a strategic plan to develop new approaches to the beneficial reuse of dredge material; and representation of a county board of health in the denial of a solid waste license before the 10th District Court of Appeals.
