Document Review & Management
Successful litigation requires not only an experienced attorney, but a well-trained support staff and cutting-edge technology. McMahon DeGulis attorneys and paralegals are adept at selecting the right software for the matter at hand and developing matrices to efficiently organize and digitize documents, review content, and capture relevant data in a way that is accessible, useful, and flexible to support the goals of litigation.
The firm routinely handles complex scientific, medical, technical, insurance and financial documents relating to a variety of industries to support our toxic tort, commercial litigation, product liability and environmental clients.
MD is uniquely equipped with resources to utilize our legal professionals in-house to complete document reviews and organization effectively. Providing our clients with in-house document review and management services means that our attorneys lead and guide the process at every stage, our clients avoid the need to contract with a third party vendor, documents are controlled, and our legal professionals provide efficient data retrieval to support our clients.
Examples of our document capabilities include:
Complex Litigation
McMahon DeGulis developed a case management system for over 50,000 cases for several clients. For one client, MD managed their cases for over 20 years and created a document cross-referencing system of analytical materials for multiple asbestos matters.
MD has handled 3,000 cases in active litigation at one time. Throughout a 6 year period of litigation, MD developed a discovery management system, analyzed and maintained over 1 million documents, and utilized a highly skilled and well trained team of paralegals to support and manage the document database. Quality control was maintained by our project manager. Additionally, MD compiled a database enabling the firm to cross-reference more than 750,000 data points necessary to support discovery.
CERCLA Cost Recovery
Over the course of four months, MD reviewed, categorized and prepared a damages report in a private cost recovery action related to a manufactured gas plant built in the mid-1800’s. Remediation costs in this matter totaled over $20 million. MD expeditiously reviewed more than 18,000 documents including manifests, pay applications and documentation from the certified professional. In the initial stages of this matter, MD’s team reviewed the extensive historical documentation of the site and neighboring properties and the multifaceted environmental remediation documentation to support the evaluation of potential PRPs.
Litigation
In a multi-million dollar wastewater treatment plant litigation initiated by our client, the firm processed and reviewed over 150,000 documents. The initial universe of documents gathered from our client included 42,000 internal emails, contracts, general operating data and daily monitoring reports spanning more than ten years. MD’s in-house team of lawyers and legal professionals performed the review and coding of the documents leading to the production of 86,898 pages of documents to opposing counsel.
The in-house litigation team also reviewed and analyzed over 32,000 documents from opposing counsel, 7,500 pages of public document requests, and over 21,000 electronic documents from our client for a second stage of document review and production.
Corporate Record Management
MD’s in-house team has also performed the review and analysis of historical documentation in support of environmental compliance and corporate and real estate transactions. For one client, MD analyzed and categorized a large volume of historical records to assist with corporate Environmental Management System compliance. MD can also review and analyze historical documentation to determine compliance with a client’s document retention policies. MD’s in-house legal team has also analyzed and assessed large volumes of complex environmental records relating to our clients’ manufacturing facilities to support corporate and real estate transactions.
