MD developed, filed, and negotiated one of the first applications for a certificate of authority from the Ohio Power Siting Board for wind farms in Ohio. We also advise on beneficial reuse and waste to energy projects are among specific projects we undertake. In addition, we utilize our compliance and enforcement experience to counsel oil, gas, wind & solar energy clients on environmental regulations encountered in their business operations. For example, we regularly represent clients in permit appeals before administrative boards such as ERAC, including a permit appeal related to Ohio EPA 401 Water Quality Certification for a pipeline.
Energy clients include an integrated oil and natural gas company, a diversified mid-stream energy company, a clean energy developer, a generator of electricity from natural gas and geothermal resources, and a developer of coal-fired power plants.
Conservancy Districts
MD’s experience working with Ohio Conservancy Districts is unparalleled. Political subdivisions of the State of Ohio, formed under ORC Chapter 6101 in response to the massive flooding in the early 20th century, conservancy districts address a variety of conservation, recreation, and water management issues, including flood control.
MD attorneys have worked with conservancy districts to draft rules and regulations for individual conservancy districts, meet reporting requirements under the Conservancy Court, review and draft lease documents, and assist with district funding, including through maintenance and capital assessment mechanisms. The firm served as litigation counsel for a large conservancy district in a construction dispute.
