Real Estate & Development
Experienced Representation for Real Estate & Development
As corporations, investors, and real estate developers consider the complexity of government regulations and financial requirements found in most deals, MD attorneys participate in due diligence and develop strategies to allow the client to minimize environmental risk and liabilities before or after the transaction. We have extensive experience with contract negotiation, real estate, and corporate transactions, including those involving local and regional governmental entities, as well as all types of transactions comprising property transfers, leases, construction, refinancing and mergers and acquisitions.
Our attorneys link clients with product resources, evaluate risk and coverage needs, advise on the structure of corporate and real estate transactions, and counsel on compliance with any applicable Financial Assurance requirements. We also prosecute claims under policies and litigate insurance coverage disputes. In many instances, the placement of environmental insurance is the key to a successful transaction. For example, we negotiated language in an environmental impairment liability policy for retail development in Cleveland’s Flats District.
MD’s real estate and development clients have included public and private developers, buyers, sellers, investors, and businesses. Our support can be provided directly to the client team coordinating the transaction or in conjunction with counsel, whether in-house or other law firms. We have niche experience supporting local land banks as they look to drive economic revitalization.
