Plotting a Course for Safety
Numerous health and safety concerns can arise out of the complex regulatory programs of the Occupational Safety and Health Administration (OSHA). MD attorneys can assist with understanding and complying with workplace safety regulations. Our attorneys work with companies to establish or support robust health and safety programs beyond compliance with OSHA standards. We advise clients on workplace health and safety concerns at both union and non-union operations.
We have experience advising on OSHA inspection preparedness and contesting citations that may arise. Our attorneys work to evaluate the citation, craft the legal and factual responses, and participate in settlement conferences. Our attorneys have also participated in formal mediation resulting in a multi-state, multi-facility federal consent decree. We counsel clients on OSHA Log reporting, responding to workplace injuries and fatalities, PEL compliance and other workplace exposure issues, and complying with the full range of OSHA standards including combustible dust, fall hazards, electrical hazards and lock-out/tag-out, and hazard communication.
We have also defended clients facing “whistleblower complaints” under Section 11(c) of the OSH Act, which prohibits employers from retaliating against employees for exercising rights such as raising health and safety concerns. MD attorneys work closely with plant operational, human resources and safety personnel in response to these complaints including evaluating the complaint, developing position statements, and negotiating resolutions with the OSHA investigator. Our attorneys also assist clients with internal investigations.
