McMahon DeGulis attorneys are adept at addressing environmental and health and safety concerns that arise out of the complex regulatory schemes of the US EPA and the Occupational Safety and Health Administration (OSHA), as well as state and local permitting authorities. Our attorneys routinely advise clients on safety compliance issues, permitting, audit protocols and enforcement actions.
Compliance and Enforcement. The firm has significant experience advising on OSHA inspection preparedness and contesting any citations that may arise. Our attorneys work to evaluate the citation, craft the legal and factual responses and participate in settlement conferences. We have particular experience with 300 Log compliance and recordability determinations, process hazard analysis and scope of documentation.
Our attorneys have counseled clients on crush injuries, amputations, hospitalizations and fatality response and reporting, asbestos standard citations, high hazard operations, including combustible dust, as well as fall hazards, electrical hazards, hazard communication citations and OSHA PEL compliance issues.
Audits. Working on behalf of several large manufacturers and publicly traded corporations, our attorneys have established world-wide environmental and safety audit protocols. Working closely with our clients, we advise on legal issues concerning the scope of the audit through the final report, and any necessary follow up actions.
