Toxic Tort
McMahon DeGulis attorneys and staff have decades of experience defending toxic tort cases, including traditional asbestos, talc, silica, and petrochemicals. Our attorneys have successfully defended many clients in thousands of cases in numerous jurisdictions around the United States. A thorough understanding of the massive body of sophisticated medical, scientific, and epidemiological literature and concepts; an in-depth familiarity with the experts in these fields, and an organization capable of handling tens of thousands of ongoing matters are essential to successfully defend these cases.
Our attorneys take a proactive approach to litigation by attempting to secure dismissals on behalf of our (or their) clients, when possible, prior to incurring unnecessary fees and costs. Prior to trial, dispositive motions are also aggressively pursued as a means of resolving a case.
As part of trial preparation, we participate in joint defense groups, which allows for cost savings, and, when appropriate, the ability to expand the pool of available experts. For its toxic tort cases, the firm is responsible for all aspects of preparing every case for trial, including, among other things, developing a defense and trial strategy, written discovery, motion practice, and both fact and expert depositions.
In addition to skilled pre-trial preparation, our litigators try cases, and the firm has obtained defense verdicts in multiple asbestos cases. Our reputation for trying, and for winning, cases enables us to better assist clients in developing a coordinated, comprehensive defense strategy, negotiate effectively, and, where advisable, try the case to verdict. Indeed, it is our extensive and successful trial experience that separates MD from other firms. Our asbestos and talc litigation team is led by trial lawyer Sandra Becher Sommers.
