Our attorneys frequently address surface water, stormwater, drinking and groundwater issues for industrial and municipal clients. This often involves NPDES permit negotiations for government and private sector clients, permits to install, stormwater construction permits, stream incident reporting, public water system regulation, and management of water quality issues. The firm also counsels clients on property rights in groundwater, Ohio’s reasonable use doctrine, riparian rights and public trust issues.
Additionally, we have extensive experience with all aspects of federal and state Clean Water Act consent decree negotiation, as well as the negotiation of administrative orders to settle alleged noncompliance. The firm’s consent decree work includes negotiating the elimination of combined and sanitary sewer overflows, application of US EPA’s Integrated Planning Framework, interpretation of consent decree obligations, and wet weather program development and implementation, including plants, storm and sanitary collection system issues, stormwater management, and water quality impacts.
